Subject
The general terms and conditions of sale described below detail the rights and obligations of the company Drakyun ("Drakyun," "we," "our," "us") and its customer within the framework of the sale of goods available on the website drakyun.com.
Any service performed by the company Drakyun implies the buyer’s unreserved acceptance of these general terms and conditions of sale.
Prices
The prices are those in effect on the date the order is placed. They are expressed in euros and calculated excluding taxes. Consequently, they will be increased by the applicable VAT rate and shipping fees on the day of the order.
Drakyun retains the right to modify its prices at any time. However, all items are charged the amount stated at the time of purchase.
Drakyun does not charge VAT on its products (VAT not applicable - Article 293 B of the French General Tax Code).
Purchases and Payment Terms
Payment for orders is made:
Either through PayPal;
Or by credit card.
The buyer agrees to provide accurate, complete, and current information, including payment and user account details, for any purchase made on the website.
Any sale is considered firm and final after order confirmation, except in the case of a manifest pricing error, which would render the product's price negligible considering its real value. In such cases, we reserve the right to cancel the order and proceed with its refund.
We reserve the right to limit or refuse any order placed on the website that, in our sole judgment, appears to be made by unauthorized resellers, wholesalers, or distributors.
Delivery
Once the order is confirmed, it is processed by Drakyun within 2 to 5 business days.
The order processing time is given only as an indication, and due to Drakyun's nature as a sole proprietorship, exceptional delays may occur.
Delivery is carried out by the French post, with or without tracking, within 3 business days to France, 2 to 5 business days to the European Union, and from a few days to several weeks elsewhere.
The delivery time indicated when the order is recorded is provided for information purposes only and is not guaranteed.
Consequently, any reasonable delay in the delivery of products cannot entitle the buyer to:
Claim damages and compensation;
Cancel the order.
Return and Refund Policy
The buyer has a right of withdrawal of 14 days from the day after delivery. The buyer must return the relevant product(s) in perfect condition and in their original packaging. Return shipping costs are entirely borne by the buyer. If the buyer returns the relevant product(s) using a shipping method more expensive than the one provided by Drakyun, the buyer must bear the cost difference between these two delivery methods.
The buyer will be refunded upon receipt by Drakyun of the returned product(s).
Legal Warranty of Conformity
Any product available for sale on the website Drakyun.com benefits from a legal warranty of conformity for a period of two years from the date of product delivery. This warranty applies to any product showing a manufacturing defect that the buyer could not have known before purchase or not corresponding to the description and various information provided by Drakyun about the product.
The buyer who notices such a defect is invited to contact us by email at lierre.contact@gmail.com.
After Drakyun confirms the lack of conformity, the buyer may receive a replacement product or, if a replacement is no longer available, a refund of their purchase.
Force Majeure
Drakyun's liability cannot be invoked if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale results from a case of force majeure. In this context, force majeure is understood as any external, unforeseeable, and irresistible event as defined by Article 1148 of the French Civil Code.
Competent Court
Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law.
In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Nantes.
